GA Child Support
When the parents of a child part ways, there are a number of issues that are generally brought before the Court, ranging from alimony to the division of marital property. However, the well-being of the child remains of the utmost importance and should be paid careful consideration by all parties involved. To ensure the continued development of the child or children in question, the Court will generally declare a certain amount of child support be paid on a monthly basis by the designated party, often referred to in legal proceedings as the obligor. If you are seeking to establish a regular payment of child support, you should consult an attorney prior to taking your case before the Court, even if you and the non-custodial parent have already agreed to a monthly sum. The intervention of an attorney becomes even more important if you and your former partner cannot come to terms on a child support figure, as they will aid you in petitioning the Court to set an amount.
Parental Alienation
Divorce proceedings are never easy, but they become all the more difficult when a child is involved. Although it is no doubt best for the child that a speedy resolution to custody and visitation disputes is reached, such cases often become heated and result in the separating parents competing against each other in a series of court battles. However, it is important to note that in most intense court proceedings between parents, both parties are acting in what they believe to be the best interest of the child.
It takes a particularly reprehensible character to base their decisions regarding custody and visitation on what is beneficial to them. A tactic commonly employed by such people is parental alienation.
Paternity vs Legitimation in GA
In Georgia, fathers who were unmarried to the mother of their child at the time of the baby’s birth may be shocked to learn that they are not bestowed automatically with legal standing or status as the father of the child in question.
In the state of Georgia, men who have fathered children out of wedlock must take the affirmative step of establishing legitimation before the state of Georgia will recognize their paternal rights under state law. An order of legitimation issued by the court grants the father the same legal rights as it relates to the child as if he were married to the mother at the time of birth.
Step Parent Adoptions in GA
Despite step-parents being recognized as key figures in the raising of their stepchildren by child psychologists and family mediation experts, a step-parent has virtually zero rights to their stepchild under Georgia law. Even a stepfather who has been caring for his stepdaughter for her entire life has no legal right to dictate how that child should be disciplined or educated. This, of course, is a cause of frustration for step-parents across the state of Georgia, and indeed the entire United States, and has been a catalyst in the vast majority of step-parent adoptions.
